DMCA Policy & Guidelines

Stacked respects the intellectual property rights of others and is committed to complying with the provisions of the Digital Millennium Copyright Act (DMCA). This DMCA Policy outlines the steps for reporting copyright infringement, as well as the procedures we follow for responding to such reports.

DMCA Notice Requirements

If you believe that your copyrighted work has been infringed upon on the Stacked website or platform, you or your authorized representative may submit a written notice of copyright infringement. To file a notice of infringement, please provide the following information:

  1. A physical or electronic signature of the copyright owner or authorized representative.

  2. Your name, title (if acting as an agent), address, telephone number, and email address.

  3. Identification of the copyrighted work(s) claimed to have been infringed.

  4. Identification of the material that is infringing or to be the subject of infringing activity and that is to be removed or access disabled, and information reasonably sufficient to permit us to locate the material.

  5. A statement that you have a good faith belief that use of the material in the manner complained of is not authorized by the copyright owner, its agent, or the law.

  6. A statement that the information in the notification is accurate, and under penalty of perjury, that you are authorized to act on behalf of the owner of an exclusive right that is allegedly infringed.

DMCA Counter-Notice Requirements

If you believe that your content was removed or access was disabled by mistake or as a result of a misidentification of the material, you may file a counter-notification. To file a counter-notification, please provide the following information:

  1. A physical or electronic signature of the user.

  2. Identification of the material that has been removed or to which access has been disabled and the location at which the material appeared before it was removed or access was disabled.

  3. A statement, under penalty of perjury, that the user has a good faith belief that the material was removed or disabled as a result of mistake or misidentification.

  4. The user's full legal name, address, telephone number (with country code), and email address.

  5. A statement that the user consents to the jurisdiction of the Federal District Court for the judicial district in which the address is located or, if the user's address is outside of the United States, to any judicial district in which Stacked may be found, and that the user will accept service of process from the person who provided the original DMCA notification or an agent of that person.

Repeat Infringers

We will terminate, in appropriate circumstances, the accounts or access of users who are repeat infringers of copyright. We may also remove content that has been the subject of multiple DMCA notices.

Review and Update

This DMCA Policy will be reviewed and updated periodically to ensure its effectiveness and compliance with relevant laws and regulations.
